OTHER GENERAL TERMS & CONDITIONS OF SALE

Deliveries: All claims for shortage or allowance must be made in writing 24 hours from date of delivery. Seller is not liable for damages resulting from injury to persons or property, or for other incidental or consequential damages. Seller shall not be liable for any delays or defaults in making delivery where occasioned by any cause of any kind or extent beyond its control, including but not limited to, action of any governmental authority, shortages of labor, raw materials productions facilities or transportation, labor difficulties, fires; floods or accidents. Seller will make delivery inside of curb or property line at the sole risk of owner or contractor requesting such service.

Risk of Loss: Risk of loss or damage to or destruction of the goods shall pass to the Purchaser upon delivery by Seller to a carrier specified by Purchaser for shipment to Purchaser or upon tender of the goods to an agent, employee, or representative of Purchaser.

Title of Merchandise: Title to the goods shall remain in Seller until the full purchase price is paid by Purchaser. If Purchaser pays by check, Seller retains title until the check is finally paid. The making of each payment when it falls due is the essence of this agreement and in case of failure to do so, or in case Purchaser fails to make any other payment due Seller then, in addition to any other remedies it may have, Seller may, at its election, cancel this contract and declare due the entire amount unpaid. The acceptance of any payment by Seller after the due date is not a waiver of this right.

WARRANTIES
There are NO warranties express or implied, which extend beyond the manufacturer's warranty. Southwest Boulder & Stone (Seller) does not know or have reason to know of any particular purpose for which you purchase the goods and does not represent that the goods shall be fit for any other purpose. You (the Buyer) are not relying on Seller's skill or judgment in the selection of goods.
